They appraised my car at 12000 however my loan was for 19000. I had gap insurance to cover the rest. I signed all the paperwork and didn&#8217;t hear anything else. However, when I go to get a new car I come to find out my GMAC loan is still open in collections. Never received a call or a letter. State farm just sent the check feb 10th 2010. A year and a month later. I have been receiving negative hits on my credit for the last year. This is crazy im besides myself. Gap insurance never sent their payment said they never got a claim. What can I do someone please help me. My credit doesn&#8217;t deserve this Thank you!<br />

			<content:encoded><![CDATA[<p>Location, Tampa Fl.  Approx 2 years ago my car broke down on the side of the interstate in a legally parked area. (I have police report)  I left with a taxi for 10 minutes to get jumpers and came back to a completely totaled car.  The driver was 18 and NOT under his parents insurance (whose car he was driving).  Since then, my insurance has taken care of settling as far as paying off the totaled car (w/gap insurance) and also covered for my rental car at that time.  However, I was just now notified by my insurance company 2 years later that they were unable to recover any money from the responsible party/at fault insurance company (which i guess they are fighting out at their level) and that i am entitled to pursue my 0 deductible.  Where do i begin??  I have researched as much as possible and am unsure who, where, and what to do.  My insurance company has absolutly no guidance they are able to give me on this matter except for all paperwork involved.  </p>

Thanks for all the prompt responses.  I never thought to call the individuals personally to give them the option.  As far as i can tell, their insurance company is a scam type of deal.  Even when the accident happened it took weeks for my insurnace to contact theirs.  And with this happening recently, I&#8217;ve tried to contact them as well myself and left several messages to no avail.  I have 4 years from the date of accident to sue by Florida law.  I appreciate the input as far as what forms and sites would help me.  Thanks again so much, all this information really helps me alot!  I&#8217;ll try to call the parents and see what they have to say, but as I recall when i spoke with them soon after the accident, they were very rude and uncooperative.  It&#8217;s not the 0 for me..  it&#8217;s the principle.  They should own up to their responsibility.</p>

<p>I dont understand why you would have to wait for a bill to come in the mail. I know tons of people that got on the insurance policy right after they got their license it didnt take a week. I dont know how this insurance stuff works so is it true you have to wait to get it approved or you are uninsured?</p>

I had my blinker on &amp; was sitting at a complete stop for about 10-15 seconds &amp; this woman struck me at full speed from behind. She has no insurance at all, expired tags, &amp; driving on a revoked license. I, on the other-hand, have full coverage insurance but I just found out that I do not have uninsured motorist property damage, but I have uninsured motorist bodily injuries. Since I have full coverage, my co. will take the responsibility of the damages but I have to pay my 0 co-pay. So, is this woman going to walk away sky free from the responsibility of the damage to my car since I don&#8217;t have UMPD? The appraiser came out this a.m. &amp; said my car is probably totaled but here is another issue, I owe more than what the car is actually worth! So, I&#8217;m going to be stuck paying the difference from what the company totals my car out at &amp; what I actually owe!! What can I do? I&#8217;m unsure if I have Gap insurance&#8230; any advice would be greatly appreciated!!!</p>

The next morning I called my insurance company and there wasn&#8217;t much of a conversation. They pretty much said I could take my car anywhere I wanted to get fixed and that I would be contacted by the &quot;adjusters&quot;. So I was like oooooooooooook.</p>
<p>I had my car towed to a transmission shop. They said I needed a new oil pan(transmission fluid pan, not motor oil). I got my car back that same day. The amount was 7. My deductible is 0.</p>
<p>Here&#8217;s my question. Since the amount I paid was less than my deductible and I paid out of pocket, will my insurance be affected at all? I have State Farm. Does it affect your rates just for **the mere fact you made a claim**? What about discounts? For example, the Accident Free discount. Would that be lost? If so, how long before those discounts are reinstated?</p>

			<content:encoded><![CDATA[<p>i have an issue with a GAP insurance company right now.  my wife totaled her car in october of 09.  we owed more on the car than retail.  our auto insurance paid their part, which was retail.  we purchased GAP insurance from a separate company at the time we financed the vehicle.  now the GAP insurer is only paying half of the remaining balance, leaving about 00 unpaid.  </p>
<p>the reason that they are saying they are not going to pay the 00 remaining is this:<br />
    When we purchased the vehicle new we also bought an extended warranty.  later during the term we decided that we didn&#8217;t want/need the extended warranty, so we cancelled it.  the credit that was due to us, about 00, was then applied back to the car.  in affect, that paid about 6 notes in advance, so we decided to live car note free for those 6 months.  </p>
<p>our GAP insurer is saying that since we did not pay on the car for 6 months, and not used that 00 credit towards the principle alone, that 00 is not eligible for coverage.  it does not specifically say, as far as i can understand, this in our contract we signed for the coverage.</p>
<p>has anyone had issues like this, or any kind of issues with GAP coverage?<br />
mbrcatz, you misunderstood me.  we did not stop making payments after the car was totalled.  we sold back the extended warrenty and stopped making payments before the accident.</p>

			<content:encoded><![CDATA[<p>Due to an illness/ disability in our family, despite having health insurance, we still owe thousands in medical bills.  Those that would not work with us turned them into collection.  They now show on our credit report.</p>
<p>Despite being insured for both our auto insurance and our home insurance for 20+ year with the same insurance company, we got a notice saying our auto insurance had gone up hundreds of dollars per year based on a credit report they obtained.  We have never had an accident, ticket, etc. and the amount automatically comes out of our checking each month.  Plus, last year, prior to this, they switched us to a preferred group within the company and gave us a discount when we threatened to switch.</p>
<p>How can I find out which insurance companies base your insurance rates on your credit report and or score?  Will they tell you outright?  This is the first I have ever known that our company did this and was wondering if all of them do it, or do you just know about it when you get a notice like we did? </p>
<p>I get their reasoning but it seems like such a rip off when so many are in our boat- insured but with insurance that is starting to pay less and less and cost more.  Plus, they have our checking account and if we were not to pay, they wouldn&#8217;t be responsible for us if we had an accident anyway.  Seems like a double whammy to me.  Can anyone help?<br />
I am in the state of Indiana.  Previously they switched us to a preferred group by sending us a letter saying we qualified and the new lower rates.  We went in and signed up and the new rates went into effect at renewal..until this latest renewal when they went even higher than our original rate they lowered.<br />
Sorry ED, but American Family is who we have had for all these years and who is doing this credit report thing.</p>
